BOSSIER CITY, LA-  Bossier Political Action Committee Calling for Bossier DA to get Involved with Criminal Charges

The Bossier City Council term limits debate has now been going on for far too long.  Of the seven Bossier City Council members, it seems five of them have fought tooth & nail to keep the option of voting for term limits out of the hands of Bossier City voters.

After now having voted twice to refuse to put term limits on a ballot, a 3 appellate judge panel from the 2nd Circuit Court of Appeal including James StephensMarcus Hunter and Danny Ellender,  issued a warning to the 5 council members, David MontgomeryDon “Bubba” WilliamsJeffrey “Jeff” DarbyJeff Free, and Vince Maggio, that they could be facing felony criminal charges, including a charge of "Malfeasance in Office." 

According to Louisiana law R.S. 14:134:  

“Malfeasance in office is committed when any public officer or public employee shall: (1) Intentionally refuse or fail to perform any duty lawfully required of him, as such officer or employee; or (3) Knowingly permit any other public officer or public employee, under his authority, to intentionally refuse or fail to perform any duty lawfully required of him, or to perform any such duty in an unlawful manner.”

Subject:  Notification of Official Misconduct and Corrupt Practices by Bossier City Council and Intent To File Charges (LA R.S. 14:134) 

Dear Mr Marvin, 

The references above enumerate the rights of the Electors in Bossier City to petition the city council to enact changes to the form or function of Bossier City government in accordance with Bossier City’s charter.  The undersigned allege that 5 Bossier City Councilmen have intentionally refused to perform their duty lawfully required of them to pass a resolution to place term limits on the ballot on December 7, 2024. The five members of Bossier City Council who willfully and knowingly failed to perform the duty lawfully required are David Montgomery, Jeffrey “Jeff” Darby, Don “Bubba” Williams, Jeff Free, and Vince Maggio.  Councilman Chris Smith and Councilman Brian Hammons repeatedly voted in favor of placing term limits on the ballot. 

Second Circuit Court of Appeal at reference (1) above, agreed [on page 8] with 26 JDC which stated the following:   

When a duly certified proposition is proposed by the electors which is not invalid the wording of the Charter itself seems to impose a mandatory duty on the Council by utilizing the word “Shall”. 

We agree.  Notwithstanding the Charter’s mandate to call an election “if any amendment is proposed by petition of the electors” the city Council twice refused [ to ] present the proposal to the voters. (footnote 8)

Footnote 8 in the 2d Circuit ruling stated “sua sponte” the following:   

Defendants’ refusal to call an election may be construed as malfeasance in office. La. R.S. 14:134 provides: 

Malfeasance in office is committed when any public officer or public employee shall:  

(1) Intentionally refuse or fail to perform any duty lawfully required of him, as such officer or employee; or

Facts to consider: 

  1. Valid certified petition received by Bossier City on 7/9/2024 
  1. City Attorney Charles Jacobs opined repeatedly that the petition was in proper format and contained the requisite number of signatures (Atch 2, P. 3) 
  1. At least one councilman stated they will never approve a term limits resolution. (Aug 13/Aug 27, 2024, council meeting recordings.) 
  1. Another councilman stated his term limit is every four years when elected. (Aug 13/Aug 27, 2024, council meeting recordings.) 
  1. If the city council had complied with their charter in a timely manner, 4 of the current councilmen who voted against placing the resolution on the ballot would not qualify for the Mar 2025 elections. 
  1. City Council may have intentionally delayed by legal action knowing they do not have the right to disregard or delay putting the petitioner’s term limits on the ballot. 

The Bossier City Term Limits Coalition, along with the undersigned electors, asserts that we have been significantly harmed by the delay caused by unwarranted legal arguments and deliberate, frivolous actions aimed at preventing retroactive term limits from being placed on the ballot. We respectfully request that a Grand Jury be impaneled to thoroughly investigate the actions of the five Bossier City Council members involved in this matter. 

We further urge the prosecution of any individuals found to have committed malfeasance in this process. Should you determine that you have a conflict of interest in pursuing this case, we request an expedited response to avoid additional delays and ensure justice is served without further obstruction.
