A Texas father who authorities said fatally beat a man he caught sexually assaulting his 5-year-old daughter won't be charged in his death.

Fox News reported that a grand jury met on Tuesday and declined to return an indictment against the 23-year-old father, saying he was authorized to use deadly force to protect his daughter.

Police said the father heard his daughter screaming on the family ranch in Shriner. Authorities said the father pulled 47-year-old Jesus Mora Flores off his daughter and beat him to death.

While the father was never arrested, Flores' death had been investigated as a homicide.

Authorities said someone spotted Flores forcibly taking the girl to a remote location on the ranch and her father went looking for her. When he heard her screams, he ran to her and found Flores, who the family had hired to help tend horses, allegedly molesting her.
