The U.S. Circuit Court of Appeals for the Fifth Circuit has denied a motion by the federal government in the states’ lawsuit challenging the constitutionality of the Obama administration’s executive order on immigration.

Louisiana Attorney General Buddy Caldwell issued the following statement:
I applaud the court’s decision to keep this injunction in place to stop the Obama administration’s illegal executive order. The Obama administration blatantly violated the Take Care Clause of the U.S. Constitution and the federal Administrative Procedure Act when it implemented the President’s deferred action plan on immigration. This proposal would thwart the will of the people and essentially grant amnesty to millions of undocumented immigrants.
Louisiana is among 26 states challenging the constitutionality of President Obama's executive order on immigration.  In April, Attorney General Caldwell attended arguments at the Fifth Circuit in New Orleans on whether to lift a stay of the federal mandate put in place by a district court judge earlier this year.
